Terms and Conditions

In these terms and conditions (the “Conditions”) “We”, “Us” or “Our” means Drive Tyne School of Motoring and “You” or “Your” means you the customer.

You must read these Conditions in full as they set out the complete terms upon which We have agreed to provide and You have agreed to obtain driving lesson tuition from Us.

Driving Tuition

Driving Tuition is only available to persons who meet the following criteria:

1.Aged 17 or over (or aged 16 if in receipt of the higher rate element of the disability living allowance)

2.Who hold a valid UK provisional driving licence (“Licence”)

3.Who are legally entitled to drive in the UK

Your Licence and Eyesight
You must hold a current, valid UK driving licence (provisional or full) and produce it on or before your first lesson. You must be fit to drive. Your eyesight will be checked on your first lesson (you must be able to read a car number plate from a distance of twenty (20) metres with glasses or contact lenses if necessary).
You must inform us of any medical condition/medication that may affect your ability to drive or obtain/retain eligibility to drive.
You must inform us IMMEDIATELY if there is any change in your eligibility for a licence or if you are no longer fit to drive, whether due to a deterioration in your eyesight or otherwise.

Payment

A booking for a first lesson will only become active once payment is made by bank transfer.
Lesson fees are payable before the scheduled lesson commences either via bank transfer or cash given directly to your instructor.

The block booking total costs are payable at the point of booking and are non-refundable. Once paid for block bookings are valid for 6 months. Lessons are non-transferable.

Lessons
Your instructor will do all they can to ensure that your lessons start and finish on time, but we reserve the right to cancel, postpone or change lesson lengths and start/finish times under certain circumstances (e.g. dangerous weather conditions). In the event of postponement fees paid in advance will be carried forward.
Your instructor will make every effort to arrive on time for your lesson. If they believe they may be late, they will (where possible) be in touch to inform you. If they are late, they will either make the time up at the end of the lesson or, if that is not possible, the time will be added onto the next lesson by mutual agreement.
If you are late, the lesson will not be extended and will still finish at the allotted time.

Lesson Cancellation Policy
If you need to cancel or rearrange a lesson, you must give your instructor at least 48 hours’ notice. Failure to provide this period of notice will result in you being charged the full lesson fee.

If you do not show for your lesson your instructor will attempt to contact you and will wait 15 minutes before leaving. If this happens, you will be charged the full lesson fee and any other lessons booked may be subject to cancellation.
Your instructor reserves the right to cancel a lesson at short notice if they believe you may be unfit due to the effects of alcohol, drugs (prescribed or otherwise) or any other condition that would cause your driving to be dangerous or illegal. In such circumstances you must pay the full lesson fee. Your instructor also reserves the right to refuse driving lessons to you if they deem your behaviour to be unreasonable.

Cancellation of a test

If you need to cancel or re-schedule your test (e.g., because you lose or mislay your licence), the DVSA requires at least three (3) clear working days’ notice (Monday to Saturday excluding public holidays in England) or you will forfeit the test fee (DVSA rules).

Your instructor cannot be held responsible for test appointments cancelled by the DVSA due to bad weather, sickness, staff shortages or other reasons beyond their control. Such cancellations are beyond you instructors’ reasonable control and the lesson fee and ‘use of car’ fee for the booked period will be charged. However, in such circumstances (other than bad weather) you may be able to claim limited compensation from the DVSA.

Prices

Drive Tyne School of Motoring reserve the right to change the prices of any products/services (including all tuition) at any time.

Training vehicle

The training vehicle provided is taxed, insured for the purposes of driving tuition, fully roadworthy and fitted with dual controls.

Your Instructor

Your Driving Instructor will provide you with lesson tuition at the hourly rate communicated to you and from time to time;

1.Recommend what are, in their opinion, the most appropriate training methods and aids to help you study for your theory and hazard perception test.

2.Design a course of lessons to match your specific driving and learning needs from your first lesson right through to your practical test.

3.Provide you with lessons which will last 2 hours or such other duration as you and your Instructor will agree in advance.

4.Provide a presentable, modern, properly maintained and dual controlled car for each lesson.

5.Recommend, where appropriate, advanced courses to help you develop your skills for; motorway driving, driving in extreme weather conditions and Pass Plus.

6.Give you relevant feedback during your lesson and record your development.

7.Monitor your progress, advise and recommend what is, in their opinion, the appropriate time to book your practical driving test and where required, they will advise whether it should be subsequently rescheduled.

8.Your instructor reserves the right to withhold use of their car for your test if in their opinion your driving is not at the required standard.

9.Provide training on a one-to-one basis with no other learner in the car.

10.Honour the full time booked for each lesson, which should include an introduction, practical training and a debrief at the end of your lesson.

11.At all times conduct themselves in a professional manner including;

i. Being courteous and considerate to you

ii. Avoiding physical contact except in an emergency

iii. Not smoking during your lessons

iv. Restricting mobile phone use to emergencies or for your benefit

12. Reserve the right to cancel a lesson or finish a lesson early on grounds of road safety

13. Not discriminate against you and will always abide by the law

14. Endeavour to give you two working days notice should a lesson need to be rescheduled, if your instructor cannot provide this level of notice then they will rearrange your lesson wherever possible

Your Rights

These conditions do not affect any rights you may have under consumer protection laws.

Data Protection

We will always handle your data in accordance with the Data Protection Act 1998 and the General Data Protection Regulation 2018.
